Escape from Tarkov Devs Silence YouTuber With DMCA Takedown

Escape from Tarkov developer Battlestate Games issues DMCA takedowns to stop YouTuber over false accusations.

Although copyright law Digital Millennium Copyright Copyright Act was originally intended to help content creators fight violations, it has a history of abuse as well. Things turned ugly this time between a Russian developer studio and a YouTuber.

Multiplayer tactical shooter title Escape from Tarkov developer team Battlestate Games have recently created a huge controversy within gaming community by issuing 47 DMCA claims on YouTube videos posted on the channel Eroktic.

Recently, Eroktic received two copyright complaints targeting videos where the owner of the YouTube gaming channel discussed about an alleged security breach that could affect the user base of the game, based on information received from third-party.

The developers however, disproves of this claim and characterized them as misinformation and then to put a stop to these claims spreading any further, they submitted DMCA takedown claims against the videos posted on the channel to make them disappear.

DMCA is actually designed to address copyright infringement and not to resolve other disputes, which was a problem in this case. One of the clips actually had seven seconds of in-game footage of Escape from Tarkov that comes under fair use but without any further investigation, they were taken down.

To make sure Eroktic will not be talking about their incompetence or spread "misinformation" anymore, Battlestate Games goes further to issue claims over 47 more videos from the esteemed channel that has no infringing material or whatsoever.

They took Facebook to address the ongoing issue to the community but that didn't end well as you can see in the post below.

The studio claims that user information such as passwords and personal details has not been leaked from their company database and Eroktic has falsely stated otherwise in his videos, thus damaging the company reputation.

Battlestate also said later that misinformation was only a partial reason for striking those videos and their primary concern was actually a potential "negative hype" that could've caused by them and that is how they are justifying their takedown actions.

The problem with the DMCA act is that any infringement is an infringement regardless of the intent of both parties and that gives developers and publishers the opportunity to make such claims and looks like the studio in question is simply abusing the loophole.

To show solidarity with Eroktic channel, one of Battlestate's affiliated content creators OnepegMG has resigned while another influencer known as "Klean" decided not to continue creating his popular podcast Talking Tarkov anymore.

Though many are alleging sites and YouTubers of clickbaiting as they are talking about the fiasco, we believe this is the one of the most effective way to reach out to the community. In fact, channels like BigfryTV and TheQuartering are fighting to get those strikes removed and help a fellow content creator.

Last year, YouTube star Felix Kjellberg AKA PewDiePie came under fire from co-founder of Firewatch developer Campo Santo after using a racial slur on a stream playing PlayerUnknown's Battlegrounds and threatened to issue DMCA takedown if he uses their content in any videos.
